Process

THE PROCESS

Our process is flexible to meet the needs of our clients. Generally it involves:

  • Pre-mediation stage: which generally involves a confidential meeting with the client – and their lawyer if represented. The meeting may be face to face, online or by telephone. In some cases the mediator may read documents prepared by the client or their lawyer in lieu of the meeting.

  • Mediation stage: this is where the parties involved in the dispute and the mediator meet to engage with the issues and work towards a mutual agreement. This involved for the mediation will vary. Generally a minimum of 3 hours is required. For more complex disputes a day may be set aside. Some clients benefit from more than one session. The length of the session will be discussed during pre-mediation stage.

We take your privacy seriously and ensure the process is confidential. Federal and state legislation protect the confidential communications of mediation. Where an agreement is reached we can assist with drafting that agreement.
